Terms of goods sale on the website and confidentiality
This offer establishes the procedure of selling the goods, ordered via our website, regulates the relations between a buyer and a seller when selling the goods and rendering the services.
General Provisions
When ordering the Goods, the Buyer shall agree to the following terms of selling the Goods (hereinafter referred to as the Goods Sale Terms). Should the Buyer disagree with the public offer (hereinafter referred to as the Agreement), the Buyer should stop using the service.
These Goods Sale Terms as well as information about the Goods on the Website shall be considered to be the public offer according to the legislation of Ukraine, Georgia and European Union.
This Agreement shall enter into force (shall be considered to be concluded) as soon as the Buyer sends the Order and pays on the website, which Order shall contain:
- a) address, full name, contact telephone number of the Buyer or a person indicated by the Buyer (recipient), address to which the Goods shall be delivered;
- b) name, quantity and price of the Goods;
Subject Matter of the Agreement
This Agreement is about providing the Buyer with the opportunity to buy the Goods for personal, family, household and other needs
Registration on the Website
The Buyer shall register on the Website at the address: www.makedacosmetic.com, unless the Buyer is already registered.
The Seller shall not be responsible for accuracy and correctness of information provided by the Buyer during registration.
Goods and Purchase Procedure
The Seller shall provide the availability of Goods presented on the Website. Photos attached to the Goods illustrate the Goods. Descriptions / properties attached to the Goods provide all necessary information; should there be any additional questions, visit the section “FAQ”, FB or Instagram page, indicated on the Website.
The Buyer shall bear the risk of adverse consequences for providing false information, which led to the impossibility to duly meet the Seller’s obligations to the Buyer.
Upon placing and paying for the Order on the Website the Buyer shall be provided with the order details by sending an e-mail to the e-mail address, indicated by the Buyer during registration.
Goods Delivery
These Terms shall be used when rendering services by Nova Poshta LLC.
The area of delivering the Goods presented on the Website shall not be limited by Ukraine or Georgia.
Any delay in the delivery shall be possible only in case of Force-Majeure circumstances.
When delivering the Goods, a person, responsible for the delivery thereof, shall be entitled to ask for an ID document of the recipient and to indicate the type and the number of the provided document in the Order ticket. The Seller shall ensure confidentiality and protection of personal data of the recipient.
The property in the Goods shall be transferred to the Buyer from the moment of delivery. The delivery cost of each Order shall be calculated individually on the grounds of the region and quantity of Goods.
The Seller’s obligation to deliver the Goods to the Buyer shall be considered performed when the Goods are picked up from the post office representative.
Should there be any claims to the Goods delivered (shortage, the Goods differ from those indicated in the description, production defect, other claims), the Buyer shall be entitled to send a written claim with photos attached to the e-mail address: info@makedacosmetic.com Should the Recipient present claims as specified above, the Seller shall be considered to have dully performed his/her obligations as to the Goods delivery in full.
The Goods, presented on the Website, corresponds to GOST and TR as to quality and packaging, which is confirmed by corresponding documents (certificates, etc.)
Payment Procedure
The goods price is indicated in UAH, GL, $ USA, EURO and includes the VAT.
The Goods price shall be indicated on the Website.
The Seller shall be entitled to unilaterally change the Goods price on the Website, this being said the price to the Goods already ordered by the Buyer shall not be subject to any change.
The Goods shall be paid for on the website by bank cards and through pay pal.
Purchase Return
We provide you with 100% guarantee of return or exchange of all your purchases according to the legislation of Ukraine, Georgia, EU. You are entitled to return / exchange the goods during 14 days upon purchasing the goods provided that the goods were not used, the marketable condition, original production packaging (cellophane / mica are not damaged), production labels are preserved, and the goods are accompanied with the documents that confirm the purchase on the website www.makedacosmetic.com
If you wish to return the order in full or in part, you should write a letter and attach a photo that would confirm the marketable condition, and send it to info@makedacosmetic.com. Your letter will be processed during 1-5 business days.
In case of returning adequate goods, you should pack the goods well so that the goods will not be damaged when transported, and add a signed request (original), a copy of the bill of sale / order card and your passport. Money will be sent to your banking account only upon actual receipt of the goods and check thereof during 10 business days. Money will be reimbursed in the amount of the goods cost less shipping charges for the delivery and return of the goods. Money will be sent to the bank details, indicated in the registration form.
In case of returning low quality goods you should write a letter and send it to info@makedacosmetic.com accompanied by the photos that confirm low quality of the goods: (1) general view of the goods, put on the level surface from the name side, (2) photo of the defect (damage), (3) photo of the information side of the box / goods (period of validity, bar code). Your claim will be processed during 1-5 business days. The request will not be accepted without photos, and the reimbursement will not be calculated. Money will be reimbursed in the amount, equal to the goods price. Postal costs will not be reimbursed. Money will not be reimbursed in case of a bad delivery (package damage).
Money will be sent to the bank details, indicated in the letter.
Responsibility
The Seller shall not be held liable for any damage to the Buyer due to undue use of the Goods, purchased from the Seller.
The Seller will not reimburse the Buyer’s expenses should the latter be unsatisfied with the Goods, since the level of expectations and satisfaction cannot be determined.
Confidentiality and Data Protection
CONFIDENTIALITY
During registration on the Website, the User shall provide the following information:
Full name, contact telephone number, delivery address, e-mail address.
The Website Administration does hereby admit the importance of confidentiality of personal information provided by the Website users.
The Website Administration does not collect personal data or any other personal information unless you agree to provide such information on the Website.
By providing your personal data on the Website or otherwise providing your personal data to the Website Administration you agree that the Website Administration will use your personal data, including collection, storage, use, deletion of data for the purpose of ordering, paying, delivering, returning the Goods, answering questions, orders, letter, addressed through the Website, providing you with information about the goods and services, special offers and discounts, or for any other purpose, for which your personal data were addressed to the Website Administration. By purchasing on the Website or just registering, you agree to get e-mails, SMS, calls that inform you about the order status as well as with advertising information to your e-mail addresses and phone numbers indicated during registration.
Website Administration shall be entitled to send advertising, news and technical messages to the User should the latter agree to receive such messages. The User may cancel the mailings at any time by clicking on the link “Cancel” at the bottom of the letter.
If you do not agree that your personal data will be used, please, send a notice to the Website Administration where you indicate your disagreement with the use of your personal data.
When the Website is used, a number of technical data, including IP address, cookie, browser history etc. are collected.
“Cookies” shall mean a small amount of data sent by the Website and saved by your computer browser at the hard disk, for example data of pages you visited, addresses of external websites linking to the Website. You may set your browser not to save the cookies.
Website Administration will not transfer confidential information to any third party and will use its best efforts to protect your data from unauthorized access, change, disclosure or destruction. Confidential information will be saved at a special server.
Additional Terms
Relations between the Buyer and the Seller shall be subject to provisions of Ukrainian, Georgian and EU legislation.
Should there be any questions or claims from the Buyer, the latter shall address the Seller by e-mail. Any arising discrepancies the Parties will attempt to resolve by negotiations.
